I.                     Council Action Requested.

Title

To support the Mountain Division Rail-Trail Project, a proposed extension of the trail from Main Street (Route 202) in Windham to Bridge Street in Westbrook, for inclusion in the 2027-2029 Maine DOT Work Plan and 2027-2030 PACTS TIP, and to commit the Town of Windham to its share of the ten percent local match in the amount of $810,000 toward the total estimated project cost of $16,200,000.

II.                     Basis for Council Action.

 

Council approval of this item is required because;

 

a.                     PACTS applications require endorsement by the local governing body, or “municipal officers,” and

b.                     Pursuant to Article II, Section 1 of the Charter “the Town Council, hereinafter called the ‘Council’, shall be and constitute the municipal officers of the Town,” and

c.                     Pursuant to Article II, Section 3(I) of the Charter the Council has the authority to exercise all the legislative, financial, borrowing and other powers now or hereafter given by statute to inhabitants of towns acting in Town Meeting except as otherwise provided herein and also exercise all the powers now or hereafter given by statute to municipal officers of towns.
