Title
To approve amendments to Building Construction Ordinance, Chapter 66, replacing the current ordinance to reflect the adoption of the Maine Uniform Building and Energy Code and to exempt rockeries from permitting requirements.

II.      Basis for Council Action.
 
Council approval of this item is required because;
  1. Under Article II, Section 3(I) of the Charter the Town Council shall have the power to "exercise all the legislative, financial, borrowing and other powers now or hereafter given by statute to inhabitants of towns acting in Town Meeting except as otherwise provided herein, and also exercise all the powers now or hereafter given by statute to municipal officers of towns."
 
III.      Issue Summary.
 
The current Chapter 66 was largely invalidated with the adoption of the Maine Uniform Building and Energy Code by the state. The replacement for Chapter 66 provides an update, further elaborates on the duties of the code enforcement officer and exempts rockeries from permitting requirements (in combination with the addition of a definition in Chapter 140, the subject of a separate set of ordinance amendments before the Council for adoption).
