Title

To enter into executive session under Title 1 M.R.S. § 405(6)(F) for "discussions of information contained in records made, maintained or received by a body or agency when access by the general public to those records is prohibited by statute", under 1 M.R.S.A. §405(6)(D) for “discussion of labor contracts and proposals and meetings between a public agency and its negotiators” on the collective bargaining agreement with Windham Raymond Professional Firefighters Association/IAFF Local 4095, and pursuant to 1 M.R.S.A. §405(6)(C) to discuss “the condition, acquisition or the use of real or personal property permanently attached to real property or interests therein or disposition of publicly held property or economic development only if premature disclosures of the information would prejudice the competitive or bargaining position of the body or agency.

II.                     Basis for Council Action.

 

Council approval of this item is required because;

 

a.                     The proposed article contemplates discussion of matters in executive session as permitted by statute;

b.                     The Town Council is the legislative body of the Town pursuant to Article II, Section 3(I) of the Charter; and

c.                     The proposed order contemplates “the discussion or consideration of the condition, acquisition or the use or real or personal property permanently attached to real property or interests therein since premature disclosures of the information would prejudice the competitive or bargaining position of the Town”; and

 

III.                     Issue Summary.

 

Pursuant to statute, this order requires a 3/5 majority vote.
