I. Council Action Requested.
Title
To receive public comment and act on an ordinance establishing a moratorium on the development of Car Washes in the Town of Windham.
Body
II. Basis for Council Action.
Council approval of this item is required because;
a. The Town may enact reasonable by-laws, regulations and ordinances for municipal purposes pursuant to Article I, Section 2 of the Charter,
b. The Council has the authority to act as the legislative body of the Town pursuant to Article II, Section 3 (I) of the Charter.
c. Pursuant to Article II, Section 11(B) of the Charter, after a properly noticed public hearing where all persons interested have a reasonable opportunity to be heard, the Council “may adopt the ordinance with or without amendment or reject it.”
