To receive public comment on a proposal to extend the expiration date of the Highland Lake watershed moratorium ordinance.

At its meeting of February 27, 2018 the Council enacted an emergency ordinance extending a 180-day moratorium on certain development activities in the Highland Lake watershed pursuant to Title 30-A M.R.S.A. Section 4356 for an additional 180 days. The ordinance was enacted as an emergency under the provisions of Article 2, Section 11(D) of the Charter, requiring a public hearing and vote within sixty (60) days in order for the moratorium ordinance to remain in effect.
Also attached are suggested modifications to the moratorium, limiting its applicability to subdivision and site plan applications that did not receive final approval before September 5, 2017 and new private road construction. The modifications recognize work that the Council has done to engage as part of the Highland Lake Leadership Team, amend the Surface Water Protection Ordinance to limit erosion and runoff in the watershed, and proposed Land Use Ordinance to limit phosphorus export by subdivisions and site plans (but which are still working their way through the legislative process).
