I. Council Action Requested.
Title
To approve an application submitted by Central Maine Power Company and Northern New England Telephone Operations LLC to construct and maintain buried cables, conduits, manholes and handholes, together with wire and cables, transformers, cutouts, and other equipment therein, with a starting point at the corner of Barnes Road and Twoey Drive, road being Barnes Road aka Horace Wood Road, distance of 25’, approximately +/-850’ in a northeasterly direction.

II. Basis for Council Action.
Council approval of this item is required because;
a. Title M.R.S.A. 35A § 2501 (2) states that “[E]xcept as otherwise provided, a person may not construct facilities upon and along highways and public roads without applying for and obtaining a written location permit from the applicable licensing authority.”
b. Title M.R.S.A. 35A § 2502 (1) B defines applicable licensing authority as “[T]he municipal officers or their designees, when the public way is a city street or town way or a state or state-aid-highway in the compact areas of urban compact municipalities…”

Note: Apparently, Pat Shore CMP Line Clerk had originally faxed the application to me over a month ago and I had never received it. She called me on 8/30/16 to see about the application, I told her I never received it. She e-mailed it to me yesterday, and I told her it might be better to e-mail them, rather than fax, as it probably was mixed up with all the faxes that come into the tax collection and auto registration office.
