I.                     Council Action Requested.

Title

To receive public comments and act on amendments to the Code of the Town of Windham Chapter 120 Land Use Ordinance, Article 3 Definitions, Article 4 District Standards, Article 8 Site Plan Review, and Article 9 Subdivision Review to the Planning Board for its review and recommendation.

Body

II.                     Basis for Council Action.

 

Council approval of this item is required because;

 

a.                     Section 107 of the Land Use Ordinance (Chapter 120 of the Code of the Town of Windham) states “After review and recommendation by the Planning Board, this chapter may be amended in accordance with the Town Charter,” and

b.                     The Town may enact reasonable by-laws, regulations, and ordinances for municipal purposes pursuant to Article I, Section 2 of the Charter, and

c.                     The Council has the authority to act as the legislative body of the Town pursuant to Article II, Section 3 (I) of the Charter.

 

III.                     Issue Summary.

 

These amendments were reviewed and referred by the Council to the Planning Board on August 20, 2024. The Planning Board reviewed and made its recommendation on August 26, 2024.
