I.                     Council Action Requested.

Title

To find that the requirements of 28-A M.R.S.A. § 653 have been met and to approve an application submitted by the Lake Region Eagles #4352 for a renewal liquor license.

 

Body

II.                     Basis for Council Action.

 

Council approval of this item is required because;

 

a.                     Title 28-A M.R.S.A. § 653 requires the municipal officers to act on applications for liquor licenses; or, if they fail to act within sixty (60) days, the application will be deemed to be approved by the municipal officers and ready for action by the Bureau of Liquor Enforcement, and

 

b.                     Pursuant to Article II, Section 1 of the Charter ‘[t]he Town Council, hereinafter called the ‘Council’, shall be and constitute the municipal officers of the town.”

 

III.                     Issue Summary.

 

Please refer to the attached application, along with a memo and other materials from Chief Kevin Schofield regarding calls and concerns about the club’s operation.

In either approving or denying an application, the Council must make findings as to whether statutory requirements have been met and, if not, which requirements have not been met.
