I. Council Action Requested.
Title
To approve an amendment to the Town’s Land Use Ordinance, Chapter 140, Section 400, to add Service Businesses, Landscaping as permitted uses in the C-3 District.

II. Basis for Council Action.
Council approval of this item is required because;
a. the Town may enact reasonable by-laws, regulations and ordinances for municipal purposes pursuant to Article I, Section 2 of the Charter, and
b. the Council has the authority to act as the legislative body of the Town pursuant to Article II, Section 3(I) of the Charter.
III. Issue Summary.
A previous order, 16-113, included both “construction services” and “service businesses, landscaping.” That order was not approved by the Council. This order would only add “service businesses, landscaping.” Since the Planning Board has already made a recommendation on this change, the town attorney’s opinion is that no further Planning Board consideration is required and there is no bar to this amendment being considered by the Council.
