Title
To refer amendments to the Land Use Ordinance, Chapter 140, Section 300 adding definitions relating to retail marijuana establishments as discussed at the Council meeting of March 21, 2017.

II. Basis for Council Action.
Council approval of this item is required because;
a. Section 107 of the Land Use Ordinance (Chapter 140 of the Code of the Town of Windham) states “After review and recommendation by the Planning Board, this chapter may be amended in accordance with the Town Charter.”
III. Issue Summary.
Please refer to the attached, as discussed at the Council meeting of March 21, 2017 as item CD 19-091.
The effect of the amendments would adding definitions relating to retail marijuana establishments, but not add those uses to any zone, having the effect of not permitting them anywhere in town, at least until more work has been done to determine whether, where, and under what conditions they might be permitted.
