Mobile Food Service Unit Ordinance Amendments.

Recent applications for mobile food service unit licenses have raised questions about the basis for some of the limitations in the town’s ordinance, Chapter 176 - Peddling and Soliciting. Article II (starting at Section 176-15) of the ordinance deals with these types of businesses, which are defined as:

 

a food service establishment which has all utilities and facilities contained within it, other than a power source, which has no fixed location for the operation or transaction of business and which is moved from (1) privately owned location to a different location under separate ownership not less frequently than once every four (4) hours in any twenty-four hour period, in order to serve persons otherwise present at such locations at such time.

 

Amendments have been drafted to allow for longer hours but still require the unit to be mobile by having it moved from one site to another at least once every twenty-four hours, and to open the possibility of operation at Town-owned locations such as, but not limited to, Dundee Park or Lippman Park.

 

A more extensive rewrite of the ordinance is recommended to take into account the different types of mobile food service units, and zoning considerations as to where the operation of these units would - or would not - be appropriate.
