I.                     Council Action Requested.

Title

To adopt amendments to Code Chapter 176, “Peddling and Soliciting.”

Body

II.                     Basis for Council Action.

Council approval of this item is required because;

a.                     the Town may enact reasonable by-laws, regulations and ordinances for municipal purposes pursuant to Article I, Section 2 of the Charter, and

b.                     the Council has the authority to act as the legislative body of the Town pursuant to Article II, Section 3(I) of the Charter.

III.                     Issue Summary.

The proposed amendments would increase the length of time that a mobile food service unit (MFSU) could remain on one site from not more than four (4) hours to twenty-four (24) hours and allows them to operate on public property as authorized by the town.

The amendments also apply the same criminal background language to home solicitors as for MFSUs.
