I.                     Council Action Requested.

To authorize the release of the town’s interest in property located at 13 Vacation Lane to the Little Sebago Lake Association.

II.                     Basis for Council Action.

 

Council approval of this item is required because;

 

a.                     Pursuant to Article I, Section 2 of the Charter “the Town may acquire property for any Town purpose, in fee simple or any lesser interest or estate, by purchase, gift, devise, lease, or condemnation and may sell, lease, mortgage, hold, manage and control such property as its interest may require,”

b.                     Also pursuant to Article I, Section 2 of the Charter “the administration of all the fiscal, prudential and municipal affairs of said Town, with the government thereof, except as otherwise provided by this Charter, shall be and are vested in one body of seven (7) members, which shall constitute and be called the Town Council,”

c.                     Article II, Section 1 of the Charter provides that “the Town Council, hereinafter called the "Council", shall be and constitute the municipal officers of the Town,”

d.                     Article II, Section 3(I) of the Charter authorizes the Council to “exercise all the legislative, financial, borrowing and other powers now or hereafter given by statute to inhabitants of towns acting in Town Meeting except as otherwise provided herein, and also exercise all the powers now or hereafter given by statute to municipal officers of towns,” and

e.                     This order would authorize the release of the town’s interest in real property.

 

III.                     Issue Summary.

 

At its meeting of July 25, 2017 the Council authorized a usage agreement with the Little Sebago Lake Association for the storage of its milfoil suction dredge boats, trailers, and associated equipment (copy attached). The release would, in effect, give the town’s interest in the property to the association as long as its continues to use it for its milfoil eradication efforts.
