I. Council Action Requested.
Title
To refer proposed amendments to the Land Use Ordinance, Chapter 140 of the Code of the Town of Windham, retroactive to August 7, 2018 with regard to medical marijuana caregiver retail stores to the planning board for review and recommendation.

II. Basis for Council Action.
Council approval of this item is required because;
a. Section 107 of the Land Use Ordinance (Chapter 140 of the Code of the Town of Windham) states “After review and recommendation by the Planning Board, this chapter may be amended in accordance with the Town Charter.”
III. Issue Summary.
The proposed amendments and issues related to retail adult-use and medical marijuana are the subject of a discussion item (CD 18-237) scheduled for the meeting of August 7, 2018.
A copy of the proposed amendments is attached. If enacted, the definition of “Caregiver Retail Store” would be added to Section 300 of the Land Use Ordinance and, by omitting “Caregiver Retail Store” from the lists of permitted uses in all zones, prohibits Caregiver Retail Stores from locating unless permitted prior to August 7, 2018.
