To appoint Deputy Chief John Kooistra as Health Officer for the Town of Windham for a three-year term.

II. Basis for Council Action.
Council approval of this item is required because;
a) Pursuant to Article II, Section 3(I) of the Charter, the Town Council shall "[e]xercise all the legislative, financial, borrowing and other powers now or hereafter given by statute to inhabitants of towns acting in Town Meeting except as otherwise provided herein, and also exercise all the powers now or hereafter given by statute to municipal officers of towns",
b) M.R.S.A. Title 22, Ch. 153 ? 451 (1) requires that "every municipality in the state shall employ a local health officer who is appointed by the municipal officers of that municipality", and
c) M.R.S.A. Title 22, Ch. 153 ? 451 (3) requires that "a local health officer is appointed for a term of 3 years".
III. Issue Summary.
Our previous manager acted as the town's Health Officer and a successor has not yet been appointed to this role.
We are required to inform the CDC in writing within ten days of this appointment.
