I.                     Council Action Requested.

Title

To approve the expenditure of $25,000 from Tax Increment Finance (TIF) funds and $25,000 from Recreation Impact fees for a total of $50,000 from the current fiscal year, to be utilized in combination with matching funds from the City of Westbrook, to complete a cost design summary report for the extension of the Mountain Division Trail approximately five (5) miles from Route 202 to Westbrook; said report to be used to obtain state and federal funding resources for implementation.

II.                     Basis for Council Action.

 

Council approval of this item is required because;

 

a.                     Pursuant to Title 36 M.R.S.A. Section 6232 “the legislative body of a municipality may by ordinance adopt a program to provide benefits to persons with homesteads in the community,”

b.                     Pursuant to Article II, Section 1 of the Charter the Town Council shall be and constitute the municipal officers of the Town,” and

c.                     Pursuant to Article II, Section 3(I) of the Charter the Town Council shall have the power to “exercise all the legislative, financial, borrowing and other powers now or hereafter given by statute to inhabitants of towns acting in Town Meeting except as otherwise provided herein, and also exercise all the powers now or hereafter given by statute to municipal officers of towns.”
